IMPORTANT: Please read these Terms of Service carefully before using SceneSteller. By accessing or using our Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and SceneSteller ("Company," "we," "us," or "our") governing your access to and use of the SceneSteller platform, website, and services (collectively, the "Service").
By creating an account, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
Legal Agreement: These Terms create a binding legal contract. If you are accepting on behalf of an organization, you represent that you have authority to bind that organization.
2. Eligibility
To use SceneSteller, you must meet the following requirements:
Age Requirement
You must be at least 13 years old (or 16 years old in the European Economic Area) to use the Service. If you are under 18, you must have parental or guardian consent.
Legal Capacity
You must have the legal capacity to enter into a binding contract in your jurisdiction.
Accurate Information
You must provide accurate, current, and complete information during registration and keep it updated.
Not Previously Banned
You must not have been previously suspended or removed from the Service.
3. Use of Service
3.1 Your Account
- • You are responsible for maintaining the confidentiality of your account credentials
- • You are responsible for all activities that occur under your account
- • You must immediately notify us of any unauthorized use of your account
- • We reserve the right to disable any account at any time
3.2 Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms.
3.3 Prohibited Activities
You may NOT use the Service to:
- • Upload, create, or distribute illegal, harmful, threatening, abusive, harassing, defamatory, or obscene content
- • Generate content depicting minors in inappropriate situations
- • Create deepfakes or deceptive content intended to harm individuals or mislead the public
- • Infringe upon intellectual property rights of others
- • Upload images of individuals without their consent
- • Attempt to bypass, disable, or interfere with security features
- • Use automated systems, bots, or scrapers to access the Service
- • Reverse engineer, decompile, or disassemble any part of the Service
- • Interfere with or disrupt the Service or servers
- • Violate any applicable laws or regulations
- • Share account credentials or allow others to access your account
4. AI-Generated Content
4.1 Nature of AI Generation
SceneSteller uses artificial intelligence (Google Gemini) to generate images. AI-generated content is experimental and may produce unexpected, imperfect, or inaccurate results. We do not guarantee any specific outcome.
4.2 Content Ownership
Your Input Content
You retain all rights to images you upload. By uploading, you grant us a limited license to process your images for the purpose of providing the Service.
Generated Output
Subject to these Terms, applicable law, and third-party rights, you may use generated output for personal or commercial projects. You are responsible for securing rights to any input content you upload.
No Exclusivity
AI-generated content is not exclusive. Similar outputs may be generated for other users with similar inputs.
4.3 Acceptable Uses
- • Personal projects and portfolio work
- • Commercial publishing, including social content and client deliverables
- • Educational and editorial projects
4.4 Your Responsibility
You are solely responsible for how you use generated content. You must ensure that your use complies with all applicable laws and does not infringe on the rights of others.
5. Intellectual Property Rights
Our Property
The Service, including its design, code, algorithms, features, trademarks, and content, is owned by SceneSteller and protected by intellectual property laws. All rights reserved.
Your License to Use
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service in accordance with these Terms.
Third-Party Content: The Service may reference or be inspired by copyrighted works (films, art styles, etc.) for stylistic purposes. Such references are for descriptive purposes only and do not imply endorsement or affiliation.
6. Credits and Payments
6.1 Credit System
How Credits Work
Credits are required for generation and rendering features. Subscription credits reset each billing cycle. One-time purchased credits do not expire unless otherwise stated at checkout or required by law. Credits are non-transferable.
Pricing
Credit packages are priced as displayed at checkout. Prices may change, but changes will not affect credits already purchased.
6.2 Purchases
- • All purchases are processed securely through our payment provider (Polar.sh)
- • You agree to pay all charges at the prices in effect when incurred
- • You are responsible for any applicable taxes
- • We reserve the right to refuse or cancel orders
6.3 Refund Policy
7-Day Refund Window
- • Eligible: Unused credits may be refunded within 7 days of purchase
- • Not Eligible: Used credits, partially used packages, or requests after 7 days
- • Process: Contact support@scenesteller.com with your order details
- • Timeline: Refunds processed within 5-10 business days
7. Disclaimers
WARRANTY DISCLAIMER
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that:
- • The Service will meet your specific requirements
- • The Service will be uninterrupted, timely, secure, or error-free
- • AI-generated results will be accurate, reliable, or satisfactory
- • Any defects will be corrected
- • The Service is free of viruses or harmful components
8. Limitation of Liability
LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SCENESTELLER, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- • Your access to or use of (or inability to access or use) the Service
- • Any conduct or content of any third party on the Service
- • Any content obtained from the Service
- • Unauthorized access, use, or alteration of your transmissions or content
- • AI-generated content that does not meet your expectations
Maximum Liability: Our total liability to you for all claims arising from or relating to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100 USD.
9. Indemnification
You agree to defend, indemnify, and hold harmless SceneSteller and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
- • Your violation of these Terms
- • Your use of the Service, including any content you upload or generate
- • Your violation of any third-party rights, including intellectual property rights
- • Any claim that your content caused damage to a third party
- • Your violation of any applicable law or regulation
10. Dispute Resolution
10.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
10.2 Informal Resolution
Before filing any formal dispute, you agree to first contact us at legal@scenesteller.com to attempt to resolve the dispute informally. We will try to resolve the dispute within 30 days.
10.3 Binding Arbitration
If informal resolution fails, any dispute arising from these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.
The arbitration shall be conducted in English, and the arbitrator's decision shall be final and binding.
10.4 Class Action Waiver
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If this class action waiver is found unenforceable, the entirety of this arbitration agreement shall be null and void.
10.5 Exceptions
Either party may bring claims in small claims court if eligible. Either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual property rights.
11. Termination
11.1 By You
You may terminate your account at any time by contacting support@scenesteller.com. Upon termination, your right to use the Service will immediately cease.
11.2 By Us
We may terminate or suspend your access immediately, without prior notice or liability, for any reason, including but not limited to:
- • Breach of these Terms
- • Engagement in prohibited activities
- • Fraudulent or illegal activity
- • Non-payment of fees
- • At our sole discretion for any reason
11.3 Effect of Termination
- • All licenses granted to you will terminate
- • Your access to the Service and generated content will be revoked
- • Unused credits are forfeited (no refund after termination for cause)
- • Provisions that by their nature should survive termination will survive
12. Force Majeure
We shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, pandemics, strikes, power outages, telecommunications failures, or third-party service provider failures.
13. General Provisions
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and SceneSteller regarding the Service.
Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
Waiver
Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.
Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
Modifications
We reserve the right to modify these Terms at any time. Material changes will be notified via email or in-app notice. Continued use after changes constitutes acceptance.
